albumworks Terms of Use & Conditions
1. ORDER ACCEPTANCE
All orders are accepted and handled in accordance with the conditions below. The customer accepts these conditions by using the albumworks software,
sharing a preview and/or submitting an order. albumworks reserves the right to amend these terms at any time.
When ordering you shall observe the laws of Australia and the country to which the product is being distributed.
2. RESPONSIBILITY FOR IMAGES and COPYRIGHT
As the creator of your photo product, you are solely responsible for the contents of the file you submit. Albumworks does not accept responsibility for the
contents of the file you submit.
In printing or sharing your photo product on your behalf, albumworks does NOT claim any ownership rights in the images you submit. Further we require that
the copyright in the photographs and images is held by you or you have permission to use the material. You are solely responsible for the unauthorized use
of copyright material.
3. OFFENSIVE AND/OR EXPLICIT IMAGES
albumworks reserves the right to not produce any item that it reasonably believes may contravene Australian law; contains explicit or sexual imagery; is
invasive of privacy; vulgar, obscene, profane; or which may harass or cause distress or inconvenience to, or incite hatred of, any person.
4. QUALITY AND SUBMISSION
Please take care in proofing and previewing your photo product and carefully check your spelling - once an order is placed, no changes can be made to it.
albumworks emphasises that the quality of the prints in the albums ordered will never be better than is to be expected on the basis of what you see on your
computer monitor when using the albumworks software. You should carefully examine the resolution and quality of your photos if you have any doubts about
your image quality.
5. LIABILITY
Please take care of your images and project files. Albumworks shall not accept liability for damage or loss of the files. Albumworks liability is limited
to errors which are related to production, shipping and delivery of the product.
6. INDEMNITY
You agree to indemnify albumworks against any claim made against or suffered by albumworks in connection with your use of albumworks and your breach of
these Terms of Use or your breach of any rights of third parties.
7. ONLINE PREVIEW and SHARING
On order we will by default create an online preview of your submitted project and send you by email an anonymous URL. A link in this email enables you to
have this preview deleted.
We provide 3 levels of access to your sharing to select from. You are wholly responsible for the sharing of the link and we accept no responsibility for
any viewing of your share by others for any of the share levels selected.
8. ALBUMSHARE AUTHOR PRICE SETTING
8.1 Albumshare optionally provides the ability for the author to define a price for a Product above the base albumworks Retail Price. albumworks will
produce the product on your behalf and you authorise albumworks to produce and fulfill orders placed for your Product. You agree to be bound by the terms
of this agreement by using the albumshare Service
8.2 Participation: The albumshare author price setting Service is currently only available to entities with an ABN number. To participate in the Service
you must provide an ABN and bank account BSB and Account Number details. You confirm that these details are true and you will maintain the accuracy of
these records at all times. albumworks reserves the right to remove any product from albumshare, refuse to fulfill an order or amend the terms of the
Service at its sole discretion at any time.
8.3 albumshare price setting: This Service permits you to create a Retail Price for each Product that You have ordered. The price you set must be greater
than the albumworks price to participate in the albumshare author price setting service.
8.4 Profit from the service, accounting and payment: For each product that is sold through albumshare you are entitled to an amount equal to the Price you
have set less the albumworks Base Price. albumworks will within 30 days of the end of each calendar month provide reports available at your albumshare
logon of all sales made on your behalf in the preceding month. The report will state the units sold, income received, albumworks base price and amount due
to the albumshare author member. If you are entitled to any proceeds from the sales this amount will be paid to you by EFT within 30 days of the end of the
relevant month.
8.5 Processing of albumshare orders: Customers who purchase products through the Albumshare Service are deemed to be albumworks customers and all the
conditions of the albumworks terms of use and conditions shall apply to those customers.
9. PRODUCTION
Our service level goal is to produce an order within seven working days and usually less, however this is not a guarantee. You can track your order through
each production stage at the “Track” page on the albumworks web site.
Once produced your item is dispatched according to the options in section 10.
10. DISPATCH
AUSTRALIAN ORDERS:
After production we dispatch by Courier or Australia Post depending on product and service level selected by you.
If you are not available to accept delivery, the delivery driver has the ‘Authority To Leave’ an item if he/she deems it safe to do so. If it’s not deemed
safe to leave an item, a card will be left explaining how you can receive delivery or pick-up the product at your local post office or freight depot (make
sure you take your ID with you).
INTERNATIONAL ORDERS:
For international orders weighing less than 2kgs, albumworks uses Registered Post International Parcel service. A signature is required on delivery.
Delivery times are an estimated 3-10 working days to metropolitan areas of major cities from the time the product is dispatched from our production
facility.
For international orders weighing more than 2kgs, albumworks uses Express Courier International. A signature is required on delivery. Delivery times are an
estimated 2-4 working days to metropolitan areas of major cities from the time the product is dispatched from our printing facility.
Delayed delivery is not a basis for cancellation of the order or a request for compensation.
11. GUARANTEE
If you are not completely satisfied with your product, please contact us via our contact form on the albumworks website within two weeks of delivery or
call 1300 553 448 during business hours. If there has been a production or delivery issue with your product we will happily resupply your item or refund
your order.
